Important Summary
Airbik is a marketplace platform. Hosts and Renters contract directly with each other. Airbik is not a party to those agreements and does not provide storage, parking, or rental services itself.
These Terms contain important provisions that limit Airbik's liability and require respectful, lawful use of the Platform.

- "Airbik", "we", "us" means Airbik, LLC.
- "Platform" means the Airbik website, mobile applications, and related services.
- "User" means anyone who uses the Platform.
- "Host" means a User who lists a space.
- "Renter" means a User who books a space.
- "Listing" means a space posted on the Platform.
- "Booking" means a confirmed reservation between a Host and a Renter.
- "Content" means photos, text, reviews, messages, and other content submitted to the Platform.
2. Acceptance of Terms
By accessing or using the Platform, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
Where you are presented with an "I agree" checkbox during signup, listing publication, or checkout, you acknowledge you are entering a legally binding agreement with Airbik.
3. Eligibility & Accounts
- You must be at least 18 years old to use the Platform.
- You agree to provide accurate information and keep it updated.
- You are responsible for safeguarding your password and all activity under your account.
- We may refuse service, suspend, or terminate accounts that violate these Terms or create risk.
4. Profile Photos & Visibility
4.1 Profile Photo Collection & Display
If you upload a profile photo (including a face photo), you represent it is a photo of you and you have the right to upload it. You consent to Airbik displaying your profile photo as follows:
- Hosts: your profile photo may be displayed publicly on your Listing page(s).
- After Booking: Hosts and Renters may see each other's profile photos after a Booking is confirmed.
4.2 No Misuse of Photos
You may use another User's photo only for booking-related purposes (e.g., coordination and safety in connection with a Booking). You may not copy, scrape, publish, sell, share, or use another User's photo outside the Platform, or use it to harass, stalk, discriminate, dox, or impersonate.
4.3 Removal or Changes
You may be able to change or remove your profile photo through account settings. We may restrict removal in limited cases (for example, during an active Booking or an ongoing safety investigation) where reasonably necessary to protect Users or the Platform.
5. Listings & Host Obligations
- Hosts are responsible for their Listings, including accuracy, availability, pricing, house rules, and compliance with law.
- Hosts represent they have the right to list the space and that it complies with laws, leases, HOA rules, zoning, and safety requirements.
- Hosts must not list spaces for prohibited uses or prohibited items (see Section 9).
6. Bookings, Payments, Fees
6.1 Booking Formation
A Booking is formed only when the Platform indicates the Booking is "confirmed" (or similar) and payment is authorized/processed.
6.2 Pricing (Daily and Monthly)
Listings may be offered on daily or monthly terms. Prices, taxes (if any), and service fees (if any) are shown during checkout.
6.3 Fees
Airbik may charge service fees to Hosts and/or Renters. You authorize Airbik and its payment processor to charge your payment method for the amounts shown at checkout.
6.4 No Deposit
Airbik does not collect a security deposit unless explicitly stated in the booking flow.
6.5 Chargebacks
If you initiate a chargeback, Airbik may suspend your account and may seek reimbursement for costs and losses related to the chargeback (to the extent permitted by law).
7. Cancellations & Refunds
Cancellations and refunds are governed by our Cancellation & Refund Policy, which is incorporated into these Terms. The applicable policy will be shown during checkout.
8. Reviews & Ratings
- Users may leave reviews after completed Bookings.
- Reviews must be honest and based on personal experience.
- We may remove reviews that violate our policies (e.g., hate, threats, spam, extortion, doxxing).
9. Prohibited Conduct
You may not:
- Use the Platform for illegal activity or prohibited storage/parking items.
- Post false, misleading, or stolen information or images.
- Harass, threaten, discriminate, stalk, or dox anyone.
- Scrape the Platform or collect user photos/data without permission.
- Attempt to bypass the Platform to avoid fees or solicit off-platform payments.
- Interfere with Platform security, verification, or operations.
We may remove Content and suspend or terminate accounts for violations.
10. User Content & License
You retain ownership of your Content. You grant Airbik a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), display, and distribute your Content as necessary to operate, market, and improve the Platform, including showing listing photos and profile photos as described.
You represent you have the rights to the Content you upload and that it does not violate law or third-party rights.
11. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Platform, you acknowledge our privacy practices.
12. Disclaimers
AS-IS. The Platform is provided "as is" and "as available." To the maximum extent permitted by law, Airbik disclaims all warranties, including fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
NO RESPONSIBILITY FOR USER CONDUCT. Airbik is not responsible for the acts or omissions of Hosts, Renters, or third parties, including property damage, theft, personal injury, or disputes.
NO BACKGROUND CHECKS. Airbik does not conduct background checks and does not guarantee identity. Users are responsible for evaluating risk and acting safely.
13. Limitation of Liability
To the maximum extent permitted by law, Airbik's total liability arising out of or relating to the Platform will not exceed the total fees you paid to Airbik for the Booking at issue (or USD $100 if no fees were paid), whichever is greater.
Airbik will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if advised of the possibility.
14. Indemnification
You agree to defend, indemnify, and hold harmless Airbik from any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of or related to: (a) your use of the Platform, (b) your Listing(s) or Booking(s), (c) your violation of these Terms, or (d) your Content.
15. Copyright / DMCA
If you believe Content on the Platform infringes your copyright, you may submit a notice to our designated agent. Your notice should include: (1) your contact information, (2) identification of the copyrighted work, (3) the URL/location of the allegedly infringing material, (4) a good-faith statement, (5) a statement under penalty of perjury, and (6) your signature (physical or electronic).

We may remove Content and terminate repeat infringers in appropriate circumstances.
16. Suspension & Termination
We may suspend or terminate your account, remove Content, or limit access to the Platform if we reasonably believe: (a) you violated these Terms, (b) your conduct creates risk, or (c) required by law.
You may stop using the Platform at any time. Certain provisions survive termination, including the Content license, disclaimers, limitation of liability, and indemnification.
17. Changes to the Platform or Terms
We may update the Platform and these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, by posting a notice on the Platform or emailing the address on file). Continued use after changes become effective means you accept the updated Terms.
18. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles, except where prohibited by law.
